Security: end-to-end protection

Legal basis

Three pieces of legislation govern payslip delivery in South Africa:

BCEA Section 33

Employers must provide written payment particulars on each payday, at the workplace or at a place agreed to by the employee, during ordinary working hours or within 15 minutes of the start or end of those hours. The payslip must include the employer's name, employee's name and occupation, pay period, gross and net pay, all deductions with reasons, and overtime details.

ECTA Section 12

The Electronic Communications and Transactions Act provides that a requirement for a document to be “in writing” is met if the document is in the form of a data message and accessible for subsequent reference. A PDF payslip on WhatsApp satisfies both conditions.

POPIA Section 19

Requires appropriate, reasonable technical and organisational measures to protect personal information. The combination of password-protected PDFs and WhatsApp's end-to-end encryption meets this standard. Payslip delivery falls under “compliance with a legal obligation” (BCEA), so separate employee consent for delivery is not strictly required.

FAQ

Do employees need to download an app?

No. Payslips arrive as a password-protected PDF in their existing WhatsApp chat. No app to install, no account to create, no portal to log into. If they have WhatsApp, they can receive their payslip.

What about employees who change phone numbers?

You manage the employee list on the wabill dashboard. When a number changes, update it and the next payslip goes to the new number. Previous deliveries remain in the employee's old WhatsApp chat history.

Is WhatsApp delivery BCEA compliant?

Yes. BCEA Section 33 requires written payment particulars on each payday. The Electronic Communications and Transactions Act (ECTA), Section 12, confirms that a data message accessible for subsequent reference satisfies the 'in writing' requirement. The Labour Court confirmed this in Sihlali v SABC. A PDF payslip on WhatsApp is both written and accessible for future reference.

What data does wabill need?

An employee list (CSV with names, WhatsApp numbers, and IDs) for the one-time setup, then your payslip PDFs each month. Your payroll system already generates the PDFs. Export them, upload to wabill, and we match and deliver them.

Can employees access old payslips?

Yes, in two ways. The PDF stays in their WhatsApp chat history. And you can reissue any payslip from the wabill dashboard at any time. Distribution data is kept for 12 months for employee queries and reissues.
